End User License Agreement (EULA)

This End User License Agreement ("EULA") is between you and Global Ink Alliance Ltd ("GIA", "we", "us"). It governs your installation and use of the GIA mobile application (the "App") on iOS and Android devices.

By installing, downloading, or using the App you accept this EULA. If you do not accept it, do not install or use the App.

1. Licence Grant

Subject to this EULA, GIA grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on devices that you own or control, solely for the purpose of accessing the GIA Services in accordance with our Terms of Service.

The App is licensed, not sold to you.

2. Restrictions

You will not:

• Copy, modify, translate, decompile, disassemble, or reverse-engineer the App, except where this restriction is prohibited by mandatory law
• Remove or alter any proprietary notices
• Use the App to develop a competing service
• Rent, lease, sell, sublicense, or distribute the App
• Use the App on jailbroken or rooted devices for the purpose of circumventing security
• Use the App to violate any law or these Terms

3. Acceptable Use

Your use of the App is subject to our Terms of Service, Acceptable Use Policy, Privacy Policy, and Community Guidelines, all of which are incorporated by reference.

4. Updates and Changes

We may release updates to the App from time to time. Updates may be required for the App to function correctly. We may discontinue support for older OS versions or device models.

5. Apple App Store Specific Terms

If you obtained the App from the Apple App Store, you acknowledge:

1. This EULA is between you and GIA — not Apple. Apple is not responsible for the App or its content.
2. Apple has no obligation to provide maintenance or support for the App.
3. If the App fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
4. GIA, not Apple, is responsible for product claims, including: (a) product liability claims, (b) claims that the App fails to conform to legal or regulatory requirements, and (c) consumer protection claims.
5. GIA, not Apple, is responsible for investigating and defending intellectual-property claims relating to the App.
6. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
7. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties.

Auto-renewable subscriptions, free trials, introductory offers, promotional offers, and offer codes purchased or redeemed through the Apple App Store are managed by Apple. You can manage or cancel them through your Apple ID subscription settings. Apple controls App Store billing, cancellation, and refund processing.

6. Google Play Specific Terms

If you obtained the App from Google Play, you also agree to Google Play's Terms of Service in addition to this EULA. Google is not a party to this EULA and is not responsible for the App.

Subscriptions, free trials, introductory offers, promotional offers, and promo codes purchased or redeemed through Google Play are managed by Google Play. You can manage or cancel them through Google Play subscriptions management. Google controls Google Play billing, cancellation, and refund processing.

7. Intellectual Property

The App, including all source code, design, branding, trademarks, and content owned or licensed by GIA, is the property of GIA or its licensors and is protected by copyright, trademark, and other laws.

The trademarks "GIA", "Global Ink Alliance", and the GIA logo are owned by GIA. Other trademarks displayed on the App belong to their respective owners.

8. Disclaimer of Warranties

The App is provided "as is" and "as available". To the maximum extent permitted by law, GIA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

This Section does not affect any non-excludable rights you have under your country's mandatory consumer protection laws.

9. Limitation of Liability

GIA's liability under this EULA is limited as set out in Section 21 of the Terms of Service.

10. Termination

This licence terminates automatically if you breach this EULA. You may end the licence at any time by uninstalling the App and deleting your GIA account.

11. Export Compliance

You confirm that your use of the App complies with applicable export-control laws of the United Kingdom, the European Union, and the United States.

12. Governing Law

This EULA is governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, subject to mandatory consumer rights of EU/UK residents.
